Terms of Service for IntelliXtract

1. Acceptance of Terms

By accessing or using the IntelliXtract service ("the Service"), you ("the User") agree to be bound by these Terms of Service ("Terms"). IntelliXtract is an AI-powered SaaS solution that aims to extract data from PDF documents. The Service uses artificial intelligence and machine learning to attempt to accurately identify and extract data. We strive to provide a useful tool, but the Service is provided as-is and does not guarantee perfect accuracy or completeness.

3. Reliance on the Service

- **No Guarantees:** The Service’s data extraction is automated and can be imperfect. We provide no guarantees regarding the accuracy, completeness, reliability, or suitability of extracted data for any particular purpose. - **User Responsibility:** You are solely responsible for verifying the accuracy and completeness of any data extracted using the Service before relying on it. Using the Service is at your own risk. - **Not a Substitute for Professional Advice:** The Service is not a substitute for professional advice or review. Consult with appropriate professionals for critical decision-making processes.

4. Limitations of AI and GCP

- **AI Limitations:** AI models are complex and can produce errors, biases, and unexpected results. We continually work to improve the Service, but do not guarantee that future updates will fix every error. - **GCP Dependency:** The Service relies on Google Cloud Platform (GCP) infrastructure. Its functionality depends on GCP's availability and performance. 5. Intellectual Property

All intellectual property rights relating to the Service, including but not limited to algorithms, software, design, and logos, are exclusively owned by 12328755 CANADA INC. Your use of the Service grants you a non-exclusive, non-transferable, and revocable license to use the Service for your internal business purposes, subject to these Terms.

6. Prohibited Conduct

You agree not to: - Use the Service for any unlawful or unethical purposes. - Reverse engineer, decompile, or attempt to access the source code of the Service. - Attempt to interfere with the security or operation of the Service. - Use the Service to process any data you do not have the right to process. - Extract or attempt to extract data from documents without the explicit consent of the document owner. - Use the Service for malicious, spam, or phishing activities. - Use the Service for personal use.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available," without any warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of data extracted. We do not warrant that the Service will be uninterrupted, secure, or error-free. Using the Service is at your sole risk.

8. Limitation of Liability

To the maximum extent permitted by law, we and our affiliates, directors, officers, employees, agents, and suppliers are not liable for any damages, including but not limited to direct, indirect, incidental, consequential, or punitive damages. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold us and our affiliates harmless from any claims, liabilities, damages, or expenses, including legal fees, arising from your use of the Service or violation of these Terms.
